Annual Meeting minutes
July 4, 2009


President Dave Inglehart called the Annual Meeting of the Tim’s Cove Property Owners Association to order at 10:15 a.m. There were approximately 46 people in attendance. President Inglehart stated the new procedure in place requiring those in attendance to pay their 2009 dues prior to the meeting in order to vote at the meeting, one vote per camp.

Cheryl Fairbrother, acting Secretary at the 2008 meeting read the minutes of the 2008 Annual Meeting. There being no additions or corrections, the minutes were accepted as read.

Copies of the Treasurer’s Report were passed around to all members. The subject of monies paid for the liability insurance coverage which we now have was brought into discussion. Mr. Inglehart spoke to the timing of same as it related to the Town of Willimantic changing their approach to their part in the handling of our road maintenance and the ensuing necessity for us to have coverage.

Also addressed at this time was the article which appeared in the July 1 edition of the Piscataquis Observer regarding recent legislation providing limited immunity for road association directors, commissioners and volunteers. Don Rush is looking into this as to how it affects us and/or our liability insurance policy.

Motion was made to accept the Treasurer’s Report., Motion was seconded and passed.

OLD BUSINESS

President Inglehart made a summation of events that have transpired since last year’s meeting and the death of past President Charlie Waterman in July of 2008. After giving a short review of Charlie Waterman’s report on the lawsuit, he spoke to the changes in our approach to road work that have evolved as a result of that lawsuit.

President Inglehart spoke to our putting procedures in place for avoiding liability. These include our recognizing that private property prevails and any road work requiring modification beyond routine maintenance requires getting the permission of the owner. He emphasized the danger in using members for this type of decision making. This would eliminate the use of road commissioners. Discussion followed regarding the value of road commissioners.

Issue was raised by several association members as to the legitimacy of the presidency of Dave Inglehart and whether the by-laws were followed in his election. At this time Cheryl Fairbrother read the minutes of the July 11, 2008 Board meeting. Motion was made and seconded to vote in Dave Inglehart as president. Motion passed. Motion was made and seconded to approve what happened at the July 11, 2008 Board meeting and the actions thereof. Motion was approved.

President Inglehart introduced the subject of following a different model in the decision-making for future road work. Rather than treating South Cove Road and Tim’s Cove Road separately, all roads within the Association’s purview would be considered part of a single system. Bill London was suggested as an outside person with no ties to our community who could act as an outside expert in helping guide our road and maintenance work. Discussion followed. Motion was made by Marie Barry that the roads be considered one road, that we have an outside contractor recommending decisions, and that this contractor would work with a Director from South Cove Road and a Director from Tim’s Cove Road. Motion was seconded and carried with a yes vote of 29 and a no vote of 1.

NEW BUSINESS

Nominations for the three open positions on the Board of Directors were announced. They were Ben Dever, Jan Waterman, Mac Blanchard, Don Page Jr., Glen Daukas, and Greg Kemp. A vote by paper ballot was taken, with the new Directors being Mac Blanchard, Glen Daukas and Jan Waterman.

Dave Inglehart made a request for and encouraged volunteers to continue their work on our roads. Two loads of stone will be dropped and volunteers are needed for filling potholes at the top of Sebec Shores Rd. this coming week.

Cheryl Fairbrother announced that trash pick-up is being offered by persons from Willimantic. They will pick up trash at your door on Saturday mornings at a cost of $1.50 per bag.

Marie Barry reminded camp owners not to use fertilizers on their lawns as they leach into the lake and damage the lake.

Gene Snyder asked that Director’s meeting minutes be posted on the website for members to see.

There being no further business, the meeting was adjourned at 11:45 a.m.
